for XML it's required that you:
<?xml version='1.0' encoding='ISO-8859-1'?>
<!DOCTYPE book PUBLIC '-//OASIS//DTD DocBook XML V4.1.2//EN' [
and not just the DOCTYPE line.
I think it's documented in the Author Guide.
