If you're using xml I don't think you should specify --docbook
on the xsltproc command line and your file should be xml (maybe
you only forgot to change the file extension in the example)

$ xsltproc --help
[snip]
    --docbook: the input document is SGML docbook
                                     ^^^^
[snip]

just try :
$ xsltproc ${DBXSL} validator.xml > out.html
