Update: I heard back from the author, let him know of our concerns,
and basically told him if it wasn't freely redistributable  we
wouldn't publish it. He says it is being published by prentice-hall,
so depending on his contract with them, he may not even be able to
license it properly.

I'll let you know the final resolution.
